TERMS OF SERVICE

1. Service

Fruits ("the Service") is a web application for prompt building, image generation and asset management. The Service is provided by the Fruits operator ("we", "us").

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to register an account. By creating an account, you confirm that the information you provide is accurate and that you have the right to upload any reference content you provide.

3. Acceptable use

The Service must not be used to create, upload, request, or share:

• Sexual content involving minors (CSAM) or content that sexualizes minors in any form. This is an absolute prohibition with zero tolerance.
• Content that depicts identifiable real people in sexual, harassing, defamatory, or impersonating ways without their documented consent.
• Hate speech, incitement to violence, terrorist content, or content that targets protected groups.
• Material that infringes intellectual property, trademark, or personality rights of others.
• Content that violates the EU AI Act, the Digital Services Act, or any applicable national law.
• Malware, phishing payloads, or prompt-injection attempts.

Violation may result in immediate content removal, account suspension, account deletion, and reporting to law enforcement where required by law.

4. Your content

You retain ownership of prompts and reference images you upload, and of generated images you produce, subject to the underlying model provider's terms (OpenAI and Google). You grant us a limited, non-exclusive license to store, process, and display your content for the sole purpose of operating the Service for you.

If you provide a Bring-Your-Own-Key (BYOK) API key, your generation requests are sent to the corresponding provider and are subject to that provider's terms and privacy policy.

5. AI-generated content disclaimer

Generated images are produced by third-party AI models. Output may be unexpected, inaccurate, or offensive despite our safeguards. You are responsible for reviewing generated content before use, and for ensuring it complies with applicable law in your jurisdiction.

6. Account suspension and termination

We may suspend or terminate accounts that violate these Terms, abuse the Service, or expose us to legal risk. You may delete your account at any time from your Settings; account deletion is soft for 30 days, then irreversibly purged (see Privacy Policy).

7. Reporting and takedowns

To report content that violates these Terms, see our Notice and Takedown procedure. We comply with the EU Digital Services Act notice-and-action requirements and the US DMCA where applicable.

8. Liability

The Service is provided "as is". To the maximum extent permitted by applicable law, we exclude implied warranties and limit our aggregate liability to amounts you have paid us, if any, in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under EU consumer law.

9. Changes

We may update these Terms. Material changes will be communicated via the Service or by email at least 14 days before they take effect.
